CT, moments after a seven-day judicial stay expired, Gun Owners of America (GOA) and lead plaintiff Silencer Shop formally executed the first transfer of firearm suppressors to private citizens without submitting ATF Form 4 registration paperwork or entering the items into a federal registry database.

The historic transaction took place at Silencer Shop’s storefront in Leander, Texas, with key figures in attendance including U.S. Representative Andrew Clyde (GA-09), GOA Senior Vice President Erich Pratt, Texas Congressional District 23 candidate Brandon Herrera, and Texas State Representative Wes Virdell (HD-53).

The Statutory & Judicial One-Two Punch

The historic transfer was the culmination of a two-stage legislative and judicial strategy targeted at the National Firearms Act of 1934.

  1. The Legislative Foundation: Congress enacted the GOA-backed One Big Beautiful Bill Act, which officially reduced the manufacture and transfer tax on suppressors, short-barreled rifles (SBRs), short-barreled shotguns (SBSs), and “Any Other Weapons” (AOWs) to $0.
  2. The Judicial Injunction: Because the Supreme Court ruled in Sonzinsky v. United States (1937) and NFIB v. Sebelius (2012) that NFA registration requirements are constitutional solely as an exercise of Congress’s taxing power to raise revenue, zeroing out the tax stripped the NFA of its constitutional foundation.

In Silencer Shop Foundation v. ATF, U.S. District Judge James Wesley Hendrix ruled that without an underlying tax, the federal government lacks the constitutional authority to mandate registration, Form 4 submissions, or months-long waiting periods.

Formal Notice to ATF and Midnight Transfer

Prior to conducting the transfer, legal counsel for GOA, Silencer Shop, Herrera, and Virdell formally served written notification to the U.S. Department of Justice (DOJ) and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) declaring their intent to complete the unregistered transfers immediately upon the expiration of the court’s temporary stay.

With no objections or emergency blocking orders issued by federal authorities prior to the deadline, Silencer Shop processed the suppressors for Herrera and Virdell. The items were transferred in full compliance with standard federal and state firearm purchase procedures—requiring a standard Form 4473 and a instant NICS background check, identical to purchasing a standard long gun or handgun.
