SAN JUAN, PR (3-minute read) — A lawsuit against SIG SAUER, alleging that its P320 pistol fired unintentionally, has been officially dismissed by a federal court in Puerto Rico. The case, Berrios v. SIG SAUER, was voluntarily withdrawn by the plaintiff, Elvis Ramon Green Berrios, who admitted in court filings that his P320 had no defects and could not discharge without a trigger pull. The P320 lawsuit dismissed reinforces the reliability of the firearm.

This ruling is a significant victory for SIG SAUER, as it marks the 18th lawsuit dismissed involving similar claims against the P320. Throughout the three-year litigation process, the firearms manufacturer presented scientific evidence proving that the P320 is designed with multiple safety mechanisms and cannot fire without deliberate action on the trigger. The latest P320 lawsuit dismissed sets a precedent for future cases.

P320 Lawsuit Dismissed: A Strong Defense Against Unfounded Claims

Samantha Piatt, SIG SAUER’s Senior Director of Communications, welcomed the decision, stating:

We are extremely pleased with the result in this case, which further demonstrates what so many in our industry already know: the P320 cannot fire without the trigger being pulled and is the gold-standard for safety, innovation, engineering, and quality, among striker-fired pistols. As we continue to put to rest the malicious and misleading attacks against one of the most popular pistols ever made, we are committed to supporting the millions of law-abiding citizens, law enforcement agencies, and elite military units carrying our pistol every day around the world.

The SIG SAUER P320 is one of the most widely used handguns in military and law enforcement agencies worldwide, including as the official sidearm of the U.S. military and several allied nations. Its design incorporates numerous patents related to safety mechanisms, and it has undergone extensive testing to ensure reliability.

This court decision further solidifies the P320’s reputation, pushing back against allegations that it is prone to unintended discharges. SIG SAUER remains committed to supporting law enforcement, military personnel, and responsible gun owners who trust their firearms daily.

Safety Tip: Always follow the fundamental rules of firearm safety. Regular maintenance and familiarization with your firearm’s safety features are essential for responsible ownership.
